Privacy Policy
1. Definitions
For the purposes of this Privacy Policy:
“4Real Group International Pty Ltd” includes 4Real Group International Pty Ltd (ACN 124 610 144) and each of its officers, directors, employees and agents.
“Collect/Collection” means gather, acquire or obtain by any means, information in circumstances where the individual is identifiable or identified.
“Collection Information” means the information outlined in 3 notified to individuals prior to, or as soon as practical after, the Collection of their Personal Information.
“Direct Market/Direct Marketing” means the marketing of goods or services through means of communication including written, verbal or electronic means. The goods or services which are marketed may be those of 4Real Group International Pty Ltd (4Real) or a Related Body Corporate or those of an independent third party organisation.
“Disclosure/Disclose/Disclosed” generally means the release of information outside 4Real.
“Member” means any individual over the age of 18 years (or the age of adult in your location of the age of adult is higher than 18 years) who has successfully completed the membership application form on this site.
“Opt Out” means an individual’s expressed request not to receive further Direct Marketing.
“Personal Information” means information or an opinion (including information or an opinion forming part of a database), whether true or not and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained from the information or opinion.
“Primary Purpose” is the dominant or fundamental reason for information being Collected in a particular transaction.
“Reasonably Expect/Reasonable Expectations” means a reasonable individual's expectation that their Personal Information might be Used or Disclosed for the particular purpose.
“Related Body Corporate” means a corporation which:
(a) is controlled (within the meaning of s50AA of the Corporations Act 2001) by the same person or persons or a related party (as defined in paragraph (1)) to that person as the person or persons controlling the party;
(b) owns shares in, or has some of its shares owned by, a party;
(c) has the same or similar board composition to that of a party; or
(d) is a related body corporate within the meaning of s50 of the Corporations Act 2001.
“Secondary Purposes” include:
(a) to enhance and manage the site and Service;
(b) to provide Members with ongoing information about the Service;
(c) to provide Members with information about promotions, as well as the products and services of 4Real affiliated companies and other organisations; and
(d) any related purpose which an individual could Reasonably Expect 4Real to use their Personal Information.
“Sensitive Information” means information or an opinion about an individual's:
(a) racial or ethnic origin;
(b) political opinions;
(c) membership of a political association;
(d) religious beliefs or affiliations;
(e) philosophical beliefs;
(f) membership of a professional or trade association;
(g) membership of a trade union;
(h) sexual preferences or practices; or
(i) criminal record;
that is also Personal Information.
“Service” means the service provided by 4Real to the Members available on this site.
“Use” means the handling of personal information within 4Real.
2. Introduction
2.1. 4Real is committed to taking all reasonable steps to protect Personal Information that you provide on or via this site.
2.2. This Privacy Policy sets out the 4Real approach in relation to the treatment of Personal Information. It includes information on how 4Real Collects, uses, discloses and keeps secure, individuals' Personal Information. It also covers how 4Real makes the Personal Information it holds available for access to and correction by the individual.
2.3. This policy has been drafted having regard to 4Real obligations under the Privacy Act 1988 (including the new National Privacy Principles) (Privacy Act).
2.4. This Policy is a public document and has been prepared in light of National Privacy Principle 5, Openness.
2.5. By using this site you expressly consent to our use and disclosure of your Personal Information in the manner prescribed in this Privacy Policy.
2.6. 4Real reserves the right to change this Privacy Policy at their discretion and without notice. Your continued use of this site after changes are posted constitutes your acceptance of the Privacy Policy as updated and/or amended.
3. Collection
3.1. To become a Member users are required to register with this site and submit a personal profile by answering some general/standard questions and, at their option, posting a photograph. Personal profiles are available for viewing by other Members and do not constitute Personal Information.
3.2. 4Real will only Collect Personal Information where the information is necessary for 4Real to provide you with the Service.
3.3. 4Real Collects Personal Information primarily to provide you with the Service, advise you as to any updates to the Service and to personalise and customise your experiences on this site. 4Real also Collects and uses Personal Information for Secondary Purposes.
3.4. 4Real will not Collect Sensitive Information from individuals except with consent and only where it is necessary for 4Real to Collect such information as set out in clause 3.1.
3.5. 4Real will not Collect Personal Information secretly or in an underhanded way.
4. Use
4.1. 4Real Uses Personal Information primarily for the purposes listed in 3.3 above.
4.2. If 4Real wishes to Direct Market to individuals it will ensure that:
(a) the individual is clearly notified of their right to Opt Out from further Direct Marketing;
(b) the individual is given an Opt Out in all further instances of Direct Marketing if they have not previously chosen to Opt Out; and
(c) if the individual Opts Out of all Direct Marketing the Opt Out will be respected by 4Real.
4.3. 4Real will not Use Sensitive Information for Direct Marketing.
4.4. 4Real may use Personal Information to avoid an imminent threat to a person's life or to public safety. It may also use Personal Information for reasons related to law enforcement or internal investigations into unlawful activities.
4.5. 4Real will not use Personal Information without taking reasonable steps to ensure that the information is accurate, complete and up to date.
4.6. 4Real may use non-personal demographic information and information from your personal profile to personalise your experience by allowing other Members to find you through a search and to deliver targeted advertising and promotional material to you.
5. Disclosure
5.1. 4Real may Disclose Personal Information to related or unrelated third parties if consent has been obtained from the individual. This will include obtaining the individual's consent for Disclosures made under the credit reporting requirements of the Privacy Act.
5.2. 4Real may Disclose Personal Information between Related Bodies Corporate. Where information is Disclosed to such a Related Body Corporate, that Related Body Corporate is bound by the original Primary Purpose for which the information was Collected.
5.3. 4Real may Disclose Personal Information to unrelated third parties to enable outsourcing of functions (such as billing, customer relations management and order fulfilment), where that is Disclosure or Use for a related Secondary Purpose and has been notified to individuals or where such Disclosure should be within the individual's Reasonable Expectations.
5.4. 4Real will take reasonable steps to ensure that its contracts with third parties include requirements for third parties to comply with the Use and Disclosure requirements of the Privacy Act.
5.5. 4Real may Disclose Personal Information to law enforcement agencies, government agencies, courts or external advisers where permitted or required by law.
5.6. 4Real may Disclose Personal Information to avoid an imminent threat to a person's life or to public safety.
5.7. Although 4Real uses its best endeavours to protect your Personal Information, 4Real cannot ensure that your Personal Information will never be disclosed in ways that are not set out in this Privacy Policy. We do not, therefore, guarantee that your Personal Information will always remain private.
5.8. 4Real may lawfully disclose your Personal Information if required by law or for law enforcement or regulatory purposes.
6. Cookies
This site uses cookies to identify traffic that comes through advertising and to facilitate a more user friendly experience. Cookies are small pieces of information that this site places on your computer’s hard drive so that 4Real may identify the times and dates you have visited this site. The use of cookies by web sites is common practice and, if you are uncomfortable with same, may be disabled by you through your browser settings.
7. Your use of other Members Information
Under no circumstances should you disclose Personal Information about another Member of this site without the consent of such other Member.
8. Information Security
8.1. 4Real requires employees and contractors to perform their duties in a manner that is consistent with 4Real legal responsibilities in relation to privacy and in accordance with this Privacy Policy.
8.2. 4Real will take all reasonable steps to ensure that paper and electronic records containing Personal Information are stored in facilities that are only accessible by people within 4Real who have a genuine "need to know" as well as "right to know".
8.3. 4Real’s third party billing agent uses Secure Sockets Layer and 128-bit encryption to transmit cardholder details to ensure that credit card numbers and other details are encoded and not carried on the Internet in open text. The Payment Servers use high-grade encryption (AES 256 bit) for both the securely hosted payment pages and the administration pages.
9. Access and Correction
9.1. 4Real will allow its records containing Personal Information to be accessed by the individual concerned in accordance with the Privacy Act.
9.2. 4Real will correct its records containing Personal Information as soon as practically possible, at the request of the individual concerned in accordance with the Privacy Act. You must promptly attend to updating your Personal Information if it changes.
10. Monitoring of On-Line Communications
10.1. 4Real reserves the right to moderate or monitor Members private exchanges through this site if 4Real suspects a breach of this Privacy Policy or the sites Terms and Conditions.
10.2. Member submissions that appear on a public area of the site may be monitored by 4Real and, if thought necessary, edited, deleted or removed.
11. Retention of Information
4Real keeps the information you provide it for as long as you are a Member or for as long as required under law, which ever is the longer.
12. External Links
This site may contain links to other websites. These sites may have Privacy Policies that differ from this policy and 4Real has no control over Personal Information provided on these sites.
